Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of the web application HEX ("HEX" or "the Service"), accessible at https://hex.icemaze.it, operated by Matteo Sasso ("the Operator").

By using the Service, you fully accept these Terms and the Privacy Policy. If you do not accept them, do not use the Service.

2. Description of the Service

HEX is a free web platform for collaborative event organisation. It allows users to create events, define time slots, propose activities, manage participation and invite other users.

3. Access Requirements

To create an account on HEX you must:

  1. Be at least 14 years of age, in accordance with Art. 2-quinquies of the Italian Privacy Code.
  2. Have a valid Google account for authentication.
  3. Provide truthful and up-to-date information.

If you are between 14 and 18 years old, you declare that you have the consent of your parent or legal guardian to use the Service.

4. Account and User Responsibility

You are responsible for the security of your Google account and for all activity carried out through your HEX account. In particular you agree to:

  • Not share access to your account with third parties.
  • Promptly notify the Operator in the event of unauthorised access.
  • Use the Service in compliance with applicable laws.

5. User Content

Users may create content (titles, descriptions, images, links) within the Service. By publishing content on HEX:

  • You declare that you own the rights to the published content or have the necessary authorisations.
  • You grant the Operator a non-exclusive, free and revocable licence to display, store and make available the content for the purpose of operating the Service.
  • You accept that event content is visible to other event participants and, for public events, potentially to all users.

The Operator reserves the right to remove content that violates these Terms, is offensive, illegal or reported as inappropriate. Content may be subject to automated moderation.

6. Guests

The Service allows you to add guest names (family members, friends, minors) to an event. By entering a companion's name:

  • You declare that you have the right to share such information.
  • For minor companions, you declare that you are their parent or legal guardian.
  • You accept that the companion's name is visible to all event participants.

7. Prohibited Conduct

When using the Service, it is forbidden to:

  • Publish illegal, defamatory, discriminatory, sexually explicit content or content inciting violence.
  • Use the Service for spam, phishing or malware distribution.
  • Attempt to gain unauthorised access to other users' accounts, data or systems.
  • Intentionally overload the Service infrastructure.
  • Use the Service improperly or unreasonably with respect to its purpose as an event management tool.
  • Enter personal data of third parties without their consent.

Violation of these rules may result in suspension or ban from the specific event or the entire platform, at the Operator's discretion.

8. Moderation and Suspension

The Operator and event administrators may:

  • Suspend or remove (ban) users from individual events for violations of event rules.

The Operator may:

  • Globally suspend an account from the entire platform in case of violations of these Terms.

In case of global suspension, the user will be informed and may contest the decision by contacting the Operator at the email address indicated in Section 15.

9. Service Availability

HEX is provided "as is", "as available". The Operator endeavours to ensure the continuity of the Service but does not guarantee that it will be free from errors, interruptions or vulnerabilities. The Service may be temporarily suspended for maintenance, with or without notice.

10. Limitation of Liability

To the extent permitted by applicable law, the Operator is not liable for:

  • Direct, indirect, incidental or consequential damages arising from the use or inability to use the Service.
  • Loss of data, content or information.
  • Actions, content or behaviour of other users.
  • Interruptions or malfunctions of the Service.

As the Service is provided free of charge, the Operator's liability is limited to cases of wilful misconduct or gross negligence, in accordance with Italian law.

11. Intellectual Property

The source code, design, trademarks and original content of the Service are the property of the Operator or licensed to the Operator. Users retain ownership of the content they create.

12. Account Deletion

You may request the deletion of your account at any time by contacting the Operator at the email address indicated in Section 15. In case of deletion:

  • Your name and your companions' names will be replaced with generic text to preserve the historical structure of events.
  • Activities you created will remain visible as 'orphaned' activities (without an owner) or will be reassigned.
  • Analytics data associated with your user_id will be deleted.

13. Changes to Terms

The Operator reserves the right to modify these Terms at any time. Changes will be communicated via an in-app notice. Continued use of the Service after publication of the changes constitutes acceptance of the new Terms.

14. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For any dispute arising from or relating to these Terms, the Court of Monza, Italy, shall have jurisdiction, without prejudice to the mandatory consumer forum pursuant to Legislative Decree 206/2005 (Consumer Code).

For users residing in Switzerland, these Terms are intended to comply with applicable Swiss data protection legislation (FADP/nDSG). In the event of conflict between provisions, the rule more favourable to the user shall prevail.
